The legal status of skill games in Pennsylvania continues to develop. In an opinion dated June 15, 2026, the Pennsylvania Supreme Court held that skill games are illegal slot machines under Section 5513 of the Crimes Code.

In holding skill games to be illegal gambling, the Court used a hatchet and not a scalpel by defining ‘slot machine’ in the Crime Code as the term ‘slot machine’ is defined in the PA Gaming Act, which includes essentially any amusement machine that a person pays to utilize.

We believe the effect of such a broad prohibition will force the PA General Assembly into action this year.
